In California is it illegal to modify your tail lights in any fashion?
An officer is citing me for VC26101 saying that it is illegal to modify my tail lights in any fashion. This doesn't make sense to me because countless people do modify their brake lights. In court I used the example of someone getting in an accident and replacing a Tail Light with a DOT approved trailer light. He said that would be illegal under this code. I just don't see how that is possible.
On my vehicle, all I have done is substitute my original tail lights with another set of DOT approved lights. I can't see what is wrong with that. Can anyone advise me on what code VC26101 really means and what it was intended for? Any help would be greatly appreciated.

The officer is wrong. (This is obvious--otherwise you could never replace a broken tail light if the manufacturer no longer made the identical part.) The clue is in the reference in VC 26101 to VC 26104. Any modification to lighting equipment must be with equipment which has been laboratory tested and certified to be in compliance with the DMV lighting standards (see VC 26103). Since a manufacturer is not permitted to sell modifying equipment in California which has not been certified to meet DMV standards, if the item is for sale in California it is most probably legal.
The same cannot be said for equipment obtained out of state or on the internet. Even if the manufacturer claims compliance with DOT regulations, absent the required testing and certification it would not be legal in California.
